Information about the labor dispute between ONMedU staff and the MoH of Ukraine

On November 7, 2019 (Minutes No. 6), the ONMedU Labor Collective Conference, in accordance with Part 1 of Art. 4 of the Law “On the Procedure for Settlement of Collective Labor Disputes”, selected a body representing the interests of the ONMedU staff, which, in accordance with the requirements of Part 2 of Art. 6 of the Law of Ukraine “On the procedure for the resolution of collective labor disputes”, informed the Ministry of Health of Ukraine, National Mediation and Conciliation Service, Odessa City Council, Executive Committee of Odessa City Council, Odessa Regional Council, Odessa Regional State Administration about a labor dispute between the employees of Odessa National Medical University and the Ministry of Health of Ukraine, which arose between the parties as a result of non-compliance of the Ministry of Health of Ukraine of the requirements of the labor legislation (Article 2, paragraph d) of the Law of Ukraine about settling collective labor disputes “).
Also, the Ministry of Health of Ukraine was informed about the initiation of the formation of labor arbitration for the settlement of the labor dispute in accordance with the requirements of Art. 11 of the Law of Ukraine “On the procedure for resolving collective labor disputes”. Candidates from ONMedU for participation in the work of labor arbitration have been determined, we are waiting for the reply from the Ministry of Health of Ukraine regarding its representatives. It should be noted that Art. 13 of the Law of Ukraine “On the Procedure for the Settlement of Collective Labor Disputes” states that no party of a collective labor dispute (conflict) can evade participation in the conciliation procedure.
Labor dispute resolution will help to avoid a strike – the ultimate means of resolving a labor dispute (conflict) that students and employees of ONMEDU are ready to announce.
